
For the last twenty years, one of a real estate agent’s most significant responsibilities has been the statutory duty to conduct a reasonably competent and diligent visual inspection of the on-site accessible areas of residential property containing one-to-four units and then disclose the results of the inspection to the purchaser of the property. Given all of the importance attributed to this duty, it is almost unfathomable that the legislature only provided real estate agents a few lines to write down their findings, and on a form primarily designed for the seller to make disclosures. Today, there are still some agents who do not conduct an inspection, do so in only a cursory fashion or try to delegate the inspection obligation to a third party such as a professional home inspector. This optional form is designed to aid both novice and experienced real estate agents to fulfill their statutory duty.
